Effective date: 8 October 2026
Last updated: 8 October 2026
The short version. This summary helps you read these Terms. It is not part of them; if it differs from the Terms below, the Terms apply.
- Who you deal with. aSERP is run by WATS Est. Our details are in section 31.
- What aSERP does. Every day, aSERP sends the prompts you track to third-party AI answer engines and shows how their answers mention and cite your brand, your competitors and other sources.
- What it cannot promise. AI answers change from one request to the next and can be wrong. Our figures are calculated from the answers we capture, which are a sample, not a record of every answer an engine gives. We do not control the engines and do not guarantee any visibility, ranking, traffic or sales result.
- Free trial. No payment card is needed, and we e-mail you 3 days before the trial ends. It becomes a paid plan only if an owner chooses a plan and adds a payment card: the plan then starts when the trial ends, or straight away if the owner asks, and only once its first payment succeeds. If that payment fails, we tell you by e-mail and try again at most three times within 7 days. Otherwise the trial simply ends, and nothing is charged.
- Plans bought in Billing renew automatically, every month or every year, until you cancel. You can cancel at any time in Billing; your plan then ends at the end of the period you have paid for, or earlier where the law of the country where you live allows.
- Refunds. Cancelling stops future payments. It does not refund the current period, except where these Terms or the law say so. We give no other money-back guarantee, not even for your first payment.
- Your rights. If you are a consumer, you keep the rights your local law gives you that a contract cannot take away, including any right to withdraw.
- Changes. We tell you by e-mail at least 30 days before a price change or a material change to these Terms applies to you.
- Fair use. Use aSERP lawfully. Do not misuse other people's brands, do not use prompts to obtain harmful content, and do not attack or overload the service.
- Privacy. How we handle personal data is described in our Privacy Policy. Cookies are covered by our Cookie Policy.
1. About these Terms
1.1 Who we are. aSERP is provided by WATS Est ("we", "us", "our"), registered in the Kingdom of Saudi Arabia under number 7053884479, with its registered address in Riyadh 11411, Kingdom of Saudi Arabia. Our contact details are in section 31.
1.2 What these Terms cover. These Terms of Service (the "Terms") are the contract between you and us for your use of aSERP. "aSERP" means our website at aserp.com, the aSERP app, the free tools in section 7, and everything we provide through them, free or paid.
1.3 A global service. aSERP is offered to businesses and individuals around the world. These Terms are written to work wherever you are. Section 3 explains how the consumer protection laws of your own country apply.
1.4 Other documents.
- How we handle personal data is described in our Privacy Policy. Cookies are covered by our Cookie Policy.
- If you are a business customer, our Data Processing Agreement also applies to the personal data we process on your behalf.
- What you see on our pricing page and at checkout when you buy a plan (the plan, its features and limits, the price, the billing period and any tax) is part of your contract with us.
- If you have a Custom plan, the agreement we sign with you also applies. Where it conflicts with these Terms, the signed agreement prevails.
1.5 Words with a defined meaning. In these Terms:
- "you" means the person or organisation that uses aSERP and agrees to these Terms (section 2.3 explains organisations);
- "consumer" and "business customer" have the meanings in section 3;
- "account" means your personal sign-in to aSERP;
- "company account" means a shared workspace in aSERP that holds brands, members, a plan and billing details (section 5);
- "owner" and "member" are the roles a person can have in a company account (section 5);
- "engine" means a third-party AI answer service that aSERP measures, such as ChatGPT, Claude, Gemini, Perplexity, Grok or DeepSeek;
- "prompt" means a question that aSERP sends to the engines for you, and a "tracked prompt" is a prompt that aSERP sends every day for a company account;
- "answer" means what an engine returns for a prompt;
- "results" means what aSERP produces from answers and your settings, such as scores, comparisons, alerts, recommendations, experiments and reports;
- "your content" means everything you or your members put into aSERP, such as brand names, websites, competitors, topics, prompts, settings, report recipients, and the names you put on report covers. Answers and results are not your content;
- "plan" means a paid subscription to Starter, Growth, Scale or Custom, and "trial" means the free trial in section 8;
- "billing period" means the month or the year that one payment for a plan covers (section 9.6);
- "pricing page" means our pricing page (aserp.com/pricing), in the language version you view, and "Billing" means the billing page of a company account;
- "free tools" means the free audit and the site checker in section 7.
2. Accepting these Terms and who may use aSERP
2.1 Accepting these Terms. You accept these Terms when you confirm that you agree to them where we ask you to, for example when you create an account, start a free tool or buy a plan. We record which version of these Terms you accepted, and the date and time you accepted it. If you do not agree with these Terms, do not use aSERP.
2.2 Minimum age. You must be at least 18 years old, or the age of majority where you live if that is higher, and legally able to enter into a contract. aSERP is not intended for children.
2.3 Using aSERP for an organisation. If you use aSERP for a company or other organisation, such as your employer or a client of yours, you confirm that you are authorised to accept these Terms for it. The organisation is then bound by these Terms, and "you" includes it. You personally must still follow sections 4 and 14.
2.4 Saving these Terms. You can save or print these Terms from this page. Each version shows its effective date at the top, and we give you any earlier version on request.
3. Consumers and business customers
3.1 Who is a consumer. You are a "consumer" if the consumer protection laws of the country where you live (or, for an organisation, where it has its main place of business) treat you as a consumer when you use aSERP. In some countries only individuals acting outside their trade or profession are consumers; in others, businesses can be too. Everyone who is not a consumer is a "business customer".
3.2 Your rights under the law. If you are a consumer, nothing in these Terms removes or limits any right you have under the laws of the country where you live that a contract cannot remove or limit. If any part of these Terms conflicts with those laws, those laws apply instead, and any unclear term is read in the way most favourable to you. Business customers likewise keep any right that the law applying to them does not allow a contract to exclude.
3.3 Clauses for one group only. A few clauses apply only to consumers (such as section 11.3) or only to business customers (such as sections 20.2, 23.3, 24.3, 25 and 30.6). Every other clause applies to everyone.
4. Your account
4.1 Creating an account. You can sign up with an e-mail address and a password, or with a Google account. You must confirm your e-mail address before you can use aSERP. We may also let you sign in with a link we send to your e-mail address.
4.2 Accurate details. Give us accurate details and keep them up to date, in particular your e-mail address, because we send notices to it (section 29).
4.3 Keeping your account secure. Each person needs their own account. Do not share your sign-in details; to work with others, invite them to your company account. Keep your password and sign-in links private, and tell us straight away if you think someone has used your account without permission. You are responsible for what is done through your account, unless it happened because we did not take reasonable care. If you are a consumer, you are not responsible for what someone else does through your account without your permission, unless you did not keep your sign-in details secret.
4.4 Account deletion. Account deletion is described in our Privacy Policy.
5. Company accounts, owners and members
5.1 Company accounts. Your work in aSERP happens in a company account. It holds your brands, its members, its plan and its billing details. Plan limits apply to each company account separately.
5.2 Owners and members. The person who creates a company account becomes its owner. Owners can invite and remove members, change roles, manage settings and manage billing, which includes buying, changing and cancelling a plan. Members can use the company account, manage its settings and invite others, but cannot manage billing. Each company account has a primary owner, and ownership can be transferred.
5.3 Responsibility for members. Owners decide who joins a company account and what role each member has. You are responsible for how the members of your company account use aSERP. Each member must also accept these Terms.
5.4 Disagreements about control. If people disagree about who controls a company account, we may follow the instructions of its primary owner, unless the law or a court order requires otherwise.
5.5 Number of company accounts. We may limit how many company accounts one person can own.
6. What aSERP does and how it measures
This section describes the service you receive. Please read it carefully.
6.1 What aSERP does. aSERP measures how AI answer engines talk about brands. For each company account, aSERP:
- (a) sends your tracked prompts to each engine every day;
- (b) captures each answer and identifies the brands it names, how prominently it names them, and the sources it cites;
- (c) turns those answers into results, for example scores for visibility, prominence, share of answers, citations and consistency for your brands and competitors, with an indication of how reliable each figure is; and
- (d) depending on your plan, provides recommendations, alerts, experiments and reports.
aSERP is a web application: you use it in a current version of a common web browser, with an internet connection.
6.2 How measurement works, and its limits.
- (a) Our own measurement. Our figures come from our own measurement, not from what one person sees in an app. What a person sees in an engine's own app or website can differ from the answers aSERP receives.
- (b) Engines change. Engines change over time, for example when a provider brings out a new release or retires an old one, and their answers can change with them.
- (c) Market and language. The market and language you set for a brand describe what you want to measure and can shape how its prompts are worded, but they do not make an engine answer as if from a particular place.
- (d) Answers vary. An engine can give different answers to the same prompt from one request, day or release to the next. One answer is a sample, not a fact about what every user sees.
- (e) A sample, not a full record. Results are calculated from the answers aSERP captures for your prompts, and each figure comes with an indication of how reliable it is. Where there is not enough data for a reliable figure, aSERP says so instead of showing one.
- (f) Engine problems. If an engine is unavailable, limits or refuses a request, or changes how it works, results for that engine may be missing, late or incomplete for that time.
6.3 What aSERP does not do. aSERP does not:
- (a) control or influence any engine, or have special access to one;
- (b) guarantee that any brand will be mentioned, ranked, recommended or cited, or any traffic, lead, sale or other result (section 16);
- (c) check that you own, or are connected to, the brands, websites or competitors you add (section 14.2); or
- (d) give legal, financial, investment or other professional advice.
6.4 Plans and limits. Each plan includes the features and limits shown on the pricing page when you buy it, such as the number of tracked prompts, brands and competitors per brand. Some allowances, such as measurement capacity and reports, apply to each monthly period, also on yearly plans. aSERP shows these allowances, and how much of each you have used, in Billing and where you use them. When you reach a limit, the related action stops until the next period starts, until you free up capacity (for example, by no longer tracking a prompt), or until you upgrade. We never charge for usage above your plan.
6.5 Features not yet available. Features that the pricing page describes as "first access" or "at release", such as an API, a Looker Studio connection or platform white-label, are not part of any plan until we release them. When we release them, the plans that the pricing page described as including them get them as described there, on the terms we publish at that time.
6.6 Support. You can contact us through our contact form or at complaints@aserp.com. Some plans include more support, as described on the pricing page. We do not commit to response times unless a signed Custom agreement says so.
7. Free tools
7.1 Free of charge. You can use our free tools without an account and without paying. Limits apply, for example per visitor, per website and per day. We may change, limit or stop a free tool at any time.
7.2 Free audit. You enter a public website. aSERP reads its homepage to suggest the brand, the market and example questions; you set the topic and the questions; and aSERP asks each engine your questions once. The result is a one-time snapshot, not a trend, and section 6.2 applies to it. If you then sign up or sign in, you may be able, for a limited time after the audit, to add the audited website as a brand. Results in a company account are measured every day and can differ from the free audit.
7.3 Site checker. The site checker reads a few publicly available files from a website you name, such as its crawler rules and its sitemap, and shows what an answer engine could read there.
7.4 Using the free tools. Use the free tools only for public websites and in line with section 14. Their results are for information only.
8. Free trial
8.1 What you get. A new company account can get one free trial, with the features of the Growth plan, for 14 days. The trial starts when the first brand is added to the company account. You need a confirmed e-mail address to get it.
8.2 One trial per person. Each person can get only one trial, ever, whatever company account or e-mail address they use.
8.3 No card needed. The trial is free and needs no payment card. We e-mail you 3 days before it ends, and aSERP shows a notice inviting you to add a payment card if you want to continue. The trial ends after 14 days. If no owner has chosen a plan by then, as section 8.4 describes, measurements pause, nothing is charged, and the trial does not turn into a plan.
8.4 Choosing a plan during the trial. During the trial, an owner can choose a plan and a billing period in Billing and add a payment card. The plan then starts when the trial ends, not earlier. Its first payment is taken on that day, and the plan starts only once that payment has succeeded (section 8.5). Until then, an owner can cancel it in Billing, and nothing is charged. If the owner asks for the plan to start straight away, it starts on the day of payment, and the rest of the trial ends. The end of a trial does not, on its own, allow us to charge anything: we take a payment only for a plan that an owner has chosen, with a card authorised for it.
8.5 If the first payment fails. If the first payment of a plan chosen during the trial fails, the plan does not start. Until a payment succeeds, the plan's paid features are not available, measurements pause as they do at the end of any trial, and nothing is charged for that time. We tell you by e-mail after every attempt that fails, with the amount, the currency and the plan, and with the date of the next attempt if one is planned. We try again automatically at most three times: 24 hours, 72 hours and 7 days after the first attempt failed, so there are at most four attempts in all. We stop as soon as a payment succeeds, an owner cancels the plan in Billing, the authorisation for the card is withdrawn, you withdraw from the contract (section 11.3), our payment provider does not allow another attempt, or the last attempt has been made. We do not make an attempt that your card or your bank does not allow, or that needs you to act, for example to confirm the payment with your bank; an owner can then pay in Billing. A payment whose result we do not know yet is not treated as failed: we wait for its result before we try again. If the last attempt fails, we tell you by e-mail that we have stopped trying and that the plan has not started, and we take no further payment unless an owner chooses a plan and pays again. We never charge a fee because a payment failed or was tried again. If a later attempt succeeds, the plan starts on the day of that payment, and so does its first billing period.
8.6 Changes to trials. We may change or stop offering trials. This does not affect a trial that has already started.
9. Plans, payment and automatic renewal
9.1 Plans. Starter, Growth and Scale can be bought in Billing, with monthly or yearly billing. Custom plans are agreed with us in writing and are invoiced and paid by bank transfer under the signed agreement. Sections 9.3 to 9.8 and section 10 apply to plans bought in Billing; for a Custom plan, the signed agreement sets how it is paid, renewed and changed.
9.2 Prices and currency. Prices, the billing currency and any tax are shown on the pricing page and at checkout. If your card uses another currency, your bank converts the amount and may charge you a fee for doing so.
9.3 How you buy a plan. An owner chooses a plan and a billing period in Billing. Before you pay, checkout shows the plan, the billing period, the fact that the plan renews automatically until cancelled, how to cancel, the fact that the price can change after notice (section 12), any tax, the total due and the day it is charged, and a link to these Terms. Where the law of the country where you live requires you to expressly request or agree to something, such as your plan starting straight away, checkout asks you for it separately, in a box that is never ticked in advance. You can go back and change your choices until you confirm the payment. Your bank may ask you to confirm the payment. Your plan starts, and the contract for it is made, on the day your payment succeeds. After every purchase, including an upgrade or an extra prompt pack, we send you a confirmation by e-mail, with the details of the purchase and a copy of these Terms. With each purchase, we record the version of these Terms that applied, the consents you gave, and the date and time the contract was made.
9.4 Payment. For plans bought in Billing, we accept payment cards only. Card payments are processed by our payment provider, Moyasar. You enter your card on a secure payment page, and your card details go straight to Moyasar and never reach our servers.
9.5 Saved cards. The card you pay with is saved with our payment provider so that it can be used for renewals. Owners can save more than one card, choose a default card for renewals and, if they wish, choose a second card that is charged only if the default card is declined. Other saved cards are never charged for a renewal. When you add a card without buying, your bank may hold a small amount to check the card. We cancel the hold at once, and if it is ever charged, we refund it in full.
9.6 Automatic renewal. Your plan runs for the billing period you chose, one month or one year, starting on the day you pay. It renews automatically at the end of each billing period, for a period of the same length, until you cancel. At each renewal we charge your default card (or your second card, if the default card is declined) the price of your plan for the new period (section 12), together with any extra prompt packs and any tax. A yearly plan is paid in one payment for the whole year. If a renewal payment is made late, your billing dates do not change.
9.7 Before a renewal. Billing shows your current billing period, the date of your next renewal and the amount of your next charge. For yearly plans, we also e-mail you between 30 and 45 days before each renewal, with the renewal date, the amount and how to cancel.
9.8 If a renewal payment fails. If a renewal payment fails, we tell you by e-mail, and Billing shows it and the amount due. We retry the payment automatically over the following days, and your plan stays fully active while we do, and for a grace period after the last attempt. An owner can pay the overdue amount in Billing at any time before the grace period ends. If it is still unpaid at the end of the grace period, your plan pauses: measurements stop and nothing more is charged. To continue, an owner buys a plan again. The new plan starts on the day of payment, and nothing is charged for the time the plan was paused. Some banks ask you to confirm every payment; if yours does, an automatic renewal may fail and you will need to pay in Billing.
9.9 Taxes. If we charge a tax, such as VAT, we add it to the price and show it at checkout and on your invoice. If we start charging a tax on plans that already exist, we tell you by e-mail when we start. Renewals of those plans then keep the same total, with the tax included in it, for 30 days; after that, the tax is added to the price of the plan. Billing shows the new total and the date it applies to you. If you do not want to pay the new total, you can cancel before that date (section 11.1), and you will not be charged it. If you are a business customer, you are responsible for any tax that the law of your own country requires you to account for yourself.
9.10 Invoices and receipts. For every successful payment, Billing provides an invoice or a receipt that you can print or save as a PDF. If you are a business customer, you can add your tax or VAT number to your billing details, in the format used in your country. Which document you get depends on our tax registration and on the billing details you give us. Our invoices and receipts follow the rules that apply to us.
10. Changing your plan and extra prompt packs
10.1 Upgrading. An upgrade takes effect immediately. You pay the difference in price for the rest of the current billing period, worked out by time and rounded down in your favour. From the next renewal, you pay the price of the new plan.
10.2 Downgrading. A downgrade takes effect at your next renewal. Nothing is charged or refunded for it, and you keep your current plan until then. If your company account uses more than the smaller plan allows, for example more extra prompt packs, you may need to reduce that first.
10.3 Monthly and yearly billing. A running plan cannot be switched between monthly and yearly billing. To change, cancel your plan and, once your current billing period has ended, buy a plan with the other billing period.
10.4 Extra prompt packs. Owners can add packs of extra tracked prompts to a plan, up to the number of packs the plan allows. On a yearly plan, a pack's price for each year equals its monthly price for 12 months. If you add a pack during a billing period, you pay a prorated amount for the rest of that period, and the pack's recurring price, as shown in Billing, is then added to each renewal. If you remove a pack, it stays until the end of the current billing period and is not refunded.
10.5 Trials and paused or ended plans. A trial, a paused plan and an ended plan cannot be changed. To move to a plan, an owner buys one; during a trial, section 8.4 applies.
11. Cancellation, withdrawal and refunds
11.1 Cancelling. An owner can cancel a plan at any time in Billing, without giving a reason. The cancellation takes effect at the end of the billing period you have paid for: you keep full access until then, no further payments are taken, and Billing shows the date your plan ends. We also confirm the cancellation by e-mail, with that date. Until that date, an owner can resume the plan in Billing. If the law of the country where you live gives you the right to end a plan that has renewed before the end of its new billing period, you can use that right by telling us (section 29.2). Your plan then ends as that law provides, and we refund the unused part of the billing period, in proportion to time. Custom plans end as set out in the signed agreement.
11.2 Cancelling while a payment is overdue. If a renewal payment is overdue when you cancel, your plan ends on the day you cancel and nothing more is charged.
11.3 Your right to withdraw (consumers). If you are a consumer and the law of the country where you live gives you a right to withdraw from a contract made online, you can use that right as the law allows. Whether you have this right depends on that law and on the nature and purpose of your contract (section 3.1), not on the type of your account or the name of your plan, so not every account or business customer has it. In many countries, the law lets a consumer withdraw from a purchase, such as a plan or an extra prompt pack, within 14 calendar days of the day its contract is made (section 9.3), without giving a reason. We do not extend that period, but any longer period that the law gives you applies.
- (a) How to withdraw. Before the withdrawal period ends, tell us clearly that you are withdrawing. You do not need to give a reason or wait for our approval: a notice sent before the period ends is in time. You, or a person you have authorised, can send us your notice by e-mail to complaints@aserp.com, by post to Riyadh 11411, Kingdom of Saudi Arabia or through our contact form. Your notice should say enough for us to identify the contract, for example the company account and the plan or pack concerned. You can use the withdrawal form at the end of these Terms, but you do not have to, and any other way that the law allows remains open to you. We make only the checks needed to confirm that a notice comes from you or from a person you have authorised; a check never prevents you from withdrawing and never changes the date of your notice. We record what your notice says and the date and time we received it, and we confirm both to you by e-mail without delay.
- (b) Starting early, and what you pay. Where the law requires it, a plan or pack starts during the withdrawal period only if you expressly ask for that, in a separate box at checkout that is never ticked in advance (section 9.3). Accepting these Terms is not such a request. Creating an account, signing in or running a first measurement does not, on its own, end your right to withdraw. If you asked for an early start, you pay only the amount that the law allows for the service provided until you told us you were withdrawing, in proportion to the price you agreed: for a yearly plan, a share of its yearly price, never a higher monthly rate. We add no cancellation, processing or other fee, we never charge for a free trial, and we never price the parts of a purchase separately to raise that amount. Otherwise, you pay nothing.
- (c) Your refund. We refund the rest without undue delay, and in any case within 14 days of receiving your notice, without any fee, to the card you paid with, unless you expressly agree to another method that costs you nothing. We never replace a refund with credit in aSERP unless you agree. If part of the payment has already been refunded, or is the subject of a chargeback, we take that into account so that nothing is refunded twice, still within those 14 days.
- (d) What happens next. Once you withdraw, we take no further payment under the contract you withdrew from, without waiting for your refund to be worked out. What you withdrew from, with its paid features and its new measurements, ends on the day of the refund. This does not affect your rights over your content. You do not have to delete your account to withdraw, and withdrawing is not a request to delete your account or its data.
- (e) Renewals and trials. A renewal of the same plan under the terms shown when you bought it does not start a new withdrawal period, unless the law gives you one. The end of a free trial does not, on its own, take away a right to withdraw from a plan you bought.
- (f) Limits. Where the law of your country ends or limits the right earlier, for example once the service has been fully provided, that law applies, but only when the conditions it sets are met.
- (g) Misuse. You must not give false information, pretend to be someone else, or ask for a refund of a payment that has already been refunded, and we may make the checks needed to prevent this. Withdrawing as this section allows, or using aSERP lawfully during the withdrawal period, is never misuse.
11.4 Other refunds. Payments are not refundable, except in the cases that these Terms or a written agreement with us expressly set out, or where the law requires a refund. We give no other money-back guarantee, not even for your first payment: none for a change of mind, for not using aSERP, or for not getting a business result you expected. In particular, cancelling a plan, moving to a smaller plan or removing an extra prompt pack does not give a refund for the current billing period.
11.5 Refunds we always make. We refund:
- (a) in full and automatically, any payment that was not needed, for example because your plan changed while you were paying;
- (b) in full, a card-check hold that was charged (section 9.5);
- (c) the unused part of a prepaid billing period, in proportion to time, if we end your plan for a reason that is not your fault (section 22.4), if section 14.5 applies and the law allows a refund, if you end your plan because of a change under section 21.3, if you end your plan because you do not accept a material change to these Terms (section 26.2), if you end your plan after objecting to a new sub-processor (section 7.4 of our Data Processing Agreement), or if you are a consumer and end your plan after a transfer under section 30.1;
- (d) if you are a consumer and we end your plan under section 22.2, the unused part of a prepaid billing period, in proportion to time, less any loss that your breach caused us; and
- (e) any amount the law requires, for example where aSERP was not provided as described in these Terms.
Refunds go back to the card used for the payment.
12. Price changes
12.1 Your price is protected. Your renewals are charged at the prices you agreed to for your current plan and any extra prompt packs, until a new price applies to you under this section.
12.2 Changing prices. We may change the price of a plan or of extra prompt packs for future billing periods. If a price you pay changes, we tell you by e-mail at least 30 days before you are first charged the new price. The new price applies from your first renewal on or after the date in our notice. Billing shows the amount of your next charge.
12.3 If you do not agree. You can cancel before that renewal (section 11.1), and you will not be charged the new price. If you are a consumer and the law of the country where you live requires your agreement to a new price, we ask for it; if you do not agree, you keep your current price until the end of your current billing period, and your plan then ends.
12.4 Payments already made. A price change never changes a payment that has already been made. Taxes are covered in section 9.9 and promotion codes in section 13.
13. Promotion codes
13.1 Using a code. We may offer promotion codes. A code can be used only at checkout, by someone who manages billing, and only under its conditions, for example the plans it applies to, whether it is for a first purchase only, any minimum price, how many times it can be used and until when. If a code cannot be used, checkout says so and you can continue at the full price.
13.2 What a code gives. A code gives a discount on one payment: the first payment of a new subscription. Checkout shows the discounted amount and the full price that applies from the first renewal.
13.3 Limits. Unless its conditions say otherwise, a code can be used once per company account and once per person. A code has no cash value and cannot be exchanged for money.
13.4 Misuse and changes. We may refuse a code that was not obtained or used in line with its conditions or these Terms, and we may stop offering codes at any time. This does not change a discount already given.
14. Acceptable use
14.1 General. Use aSERP only lawfully and in line with these Terms. Do not use aSERP in a way that would make us break the law or the terms of the engines.
14.2 Brands, websites and competitors. You can track any brand, website or competitor for a legitimate purpose, such as measuring your own visibility or analysing competitors, including for your clients. We do not check that you own or control what you add. You must not use aSERP or its results to pretend to be someone else, to suggest that you are connected with or endorsed by a brand or an engine when you are not, or to mislead anyone about where results come from.
14.3 Prompts and other content. Remember that prompts are sent to the engines. Do not put into aSERP, including in prompts:
- (a) content that is unlawful, defamatory, hateful, harassing or sexually explicit, or that exploits children;
- (b) prompts designed to make an engine produce such content or to get around an engine's safety measures, or that otherwise break an engine's usage policies;
- (c) personal data about individuals that is not needed to measure a brand; or
- (d) confidential information that you are not allowed to share with others.
14.4 Things you must not do. You must not:
- (a) use aSERP to monitor, profile or track private individuals (people who are not public figures);
- (b) access or copy aSERP or its results by automated means, such as scrapers or bots, except through features we provide for that;
- (c) copy, sell, resell, rent or sublicense aSERP, or offer aSERP or its results as a service of your own, except as section 17.3 allows;
- (d) reverse engineer or decompile aSERP or try to extract its source code, except where the law allows this despite this restriction;
- (e) probe, scan or test the security of aSERP, or get around its security or access controls, without our written permission;
- (f) interfere with or overload aSERP, the engines or any website, including through the free tools;
- (g) get around plan limits, usage limits, the one-trial rule or the limits on free audits, for example by creating extra accounts or using other e-mail addresses;
- (h) share your sign-in details, or let anyone else use aSERP through your account;
- (i) use aSERP or its results to build or improve a competing product, or to train an AI model;
- (j) send reports, or use aSERP to send messages, to people who have not agreed to receive them; or
- (k) let anyone under the minimum age in section 2.2 use aSERP.
14.5 Sanctions and export controls. You may not use aSERP if you are, or act for, a person or organisation that is subject to sanctions or export restrictions under the laws that apply to us or to our service providers, or if those laws prohibit us from providing aSERP to you or where you are. You must not use aSERP in breach of those laws. If we reasonably believe that this section applies, we may suspend or end your access, and we refund any prepaid amount for the unused period unless the law prohibits it.
14.6 Sharing reports. A share link lets anyone who has it open the report without signing in, until the link expires or you revoke it. You are responsible for who you give share links and reports to, and for having permission to send reports to the e-mail addresses and services you add.
14.7 What we may do. If we reasonably believe that you have broken this section, we may warn you, stop measuring a prompt, limit a feature, or suspend or end your access, in proportion to the problem. Where it is reasonable, we tell you before we act. In any case, we give you our reasons when the measure takes effect at the latest, unless the law prevents us. You can ask us to review a decision by writing to complaints@aserp.com. If you believe that something in aSERP is unlawful, you can tell us at the same address.
15. Your content
15.1 You keep your rights. You keep all your rights in your content. These Terms do not transfer them to us.
15.2 Permission you give us. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display your content: (a) to provide, secure and support aSERP; (b) to improve aSERP and to produce aggregated statistics, in both cases using only content that is not personal data and in a way that does not identify you, your company account or your brands; and (c) to comply with the law. This includes sending your prompts, and the brand, competitor and market details in them, to the engines, which handle them under their own terms. Our service providers may use your content for these purposes on our behalf. We do not use your content or your results to train AI models.
15.3 Your responsibility for your content. You are responsible for your content. You confirm that you have the rights and permissions it needs, including for any name you put on a report cover, and that your content and our use of it under these Terms do not break any law or anyone else's rights.
15.4 Personal data. If you are a business customer and your content includes personal data about other people, you are responsible for having a lawful basis to use it with aSERP. How we handle personal data is described in our Privacy Policy.
16. AI answers, results and recommendations
16.1 Engines are independent. The engines are run by other companies. We do not control them, and aSERP is not affiliated with, sponsored by or endorsed by any of them.
16.2 Trademarks. ChatGPT, Claude, Gemini, Perplexity, Grok, DeepSeek and the names of other engines, brands and products shown in aSERP are trademarks of their owners. We use them only to identify the engines and the brands that appear in answers.
16.3 Answers come from the engines. Answers are written by the engines, not by us. They can be wrong, incomplete, out of date, biased or offensive, and they can contain material that belongs to others, such as quoted text or links to other websites. We show answers so that you can see what the engines say; they are not our statements or our advice. Check an answer before you rely on it, quote it or publish it, and make sure you have any permission you need.
16.4 Results describe a sample. Scores, comparisons and alerts are calculated from the answers aSERP received for your prompts during the measured period. They are not a record of what every user of an engine sees, and they can change when the engines change.
16.5 Recommendations and experiments. Recommendations are suggestions based on measured data. Some explanations are written by an AI model, and they are labelled as such. Experiments compare measurements from before and during a change you make; they cannot prove that your change caused a difference. You decide whether and how to act, and you are responsible for what you publish.
16.6 No guaranteed outcomes. We do not guarantee that using aSERP, or following any recommendation, will improve your visibility, rankings, mentions, citations, traffic, leads, sales or any other outcome. The engines decide their answers on their own.
16.7 Not professional advice. Nothing in aSERP is legal, financial, investment or other professional advice.
17. Intellectual property
17.1 Our rights. Apart from your content and third-party material (such as answers and the pages they cite), aSERP and the results belong to us or our licensors. This includes aSERP's software, design, methods, scoring, text and graphics, and the aSERP name and logo. These Terms do not transfer any of these rights to you.
17.2 Your right to use aSERP. While you have access to aSERP, we give you a non-exclusive, non-transferable right to use it for your own purposes, in line with these Terms and your plan.
17.3 Using results. You may download, export, copy and share results for your own purposes, including with your own clients if you provide services to them, for example as an agency. When you share answers, section 16.3 applies.
17.4 Our name. You may not use the aSERP name or logo without our permission, except to refer to aSERP accurately.
18. Feedback
If you send us ideas or suggestions, we may use them freely, without paying you or naming you. You do not have to send feedback.
19. Third-party services
19.1 Services run by others. aSERP works with services run by other companies, including the engines, our payment provider, sign-in with Google, and services you connect yourself, such as a messaging service for report delivery. Their own terms and policies apply to your use of them.
19.2 Our responsibility. We are not responsible for those services themselves, for example for their availability, their content or their changes. If an engine changes or stops its service or its terms, we may change how, or whether, we measure that engine (section 21.3). This does not limit our responsibility for aSERP under these Terms.
19.3 Other websites. Answers and results can link to websites run by others. We do not control those websites.
20. Confidentiality
20.1 Your information. We treat your content and the results of your company account as confidential. We share them only as needed to provide aSERP (including sending prompts to the engines and using service providers), with your permission (for example when you create a share link or set up report delivery), as part of a transfer under section 30.1, or when the law requires us to. Aggregated statistics that do not identify you, your company account or your brands are not confidential.
20.2 Our information. If you are a business customer, you must treat non-public information we give you about aSERP, such as a Custom proposal, unreleased features or security information, as confidential, and use it only to evaluate or use aSERP.
20.3 Exceptions. These duties do not apply to information that becomes public through no fault of the party receiving it, that it already knew lawfully, that it develops independently, or that it lawfully receives from a third party who owed no duty of confidence over it.
21. Availability and changes to aSERP
21.1 Availability. We work to keep aSERP available and working well, but we do not promise that it will always be available, uninterrupted or free of errors. We may need to interrupt it, for example for maintenance or security. aSERP has no service-level commitment unless a signed Custom agreement includes one.
21.2 Measurement depends on the engines. Section 6.2 explains how engine changes and problems can affect results.
21.3 Changes to aSERP. We may change aSERP to improve it or keep it secure; to follow changes made by the engines, such as a new or retired release of an engine, or new terms or prices from an engine provider; to comply with the law or a requirement of a court or an authority; or, for important technical or operational reasons, to add, replace or stop measuring an engine, or to add, change or stop a feature. Changes come at no extra cost during your current billing period. If a change reduces what your plan includes, or negatively affects your access to or use of aSERP, in more than a minor way, we tell you by e-mail at least 30 days before it applies, or as early as we can if an engine or the law forces the change sooner. Our notice describes the change, when it applies and your right to end your plan. You can then end your plan by telling us within 30 days after our notice or after the change, whichever is later, and we refund the unused part of any prepaid billing period.
22. Suspension and ending
22.1 You can stop at any time. You can stop using aSERP, and cancel your plan (section 11), at any time. Account deletion is covered in section 4.4.
22.2 When we may suspend or end your access. We may suspend or end your access to aSERP, or to a company account, if:
- (a) you seriously or repeatedly break these Terms;
- (b) the law, a court or an authority requires it, or section 14.5 applies;
- (c) your use creates a risk to the security of aSERP, the engines, other users or anyone else; or
- (d) you use aSERP fraudulently, for example to get trials or free audits you are not entitled to.
We act in proportion to the problem. Where it is reasonable, we tell you first and give you a chance to put things right. In any case, we give you our reasons when the measure takes effect at the latest, unless the law prevents us.
22.3 Unpaid renewals. If a renewal payment is not made, your plan pauses as described in section 9.8.
22.4 Ending for other reasons. We may stop providing aSERP, or a plan, to all customers by giving you at least 30 days' notice by e-mail. If you are a business customer, we may also end your plan for any other reason with the same notice. In both cases, we refund the unused part of any prepaid billing period.
22.5 What happens at the end. When a plan ends or pauses, its paid features and its measurements stop. When your access to aSERP ends, your right to use aSERP ends. Section 30.10 lists the clauses that continue. How we handle personal data is described in our Privacy Policy.
23. Our commitment and disclaimers
23.1 Our commitment. We provide aSERP with reasonable care and skill and as described in these Terms.
23.2 Consumers. If you are a consumer, you have legal rights if aSERP is not provided as described or with reasonable care and skill. Nothing in these Terms affects those rights.
23.3 Business customers. If you are a business customer, then apart from what these Terms expressly say, and to the extent the law allows, aSERP is provided "as is" and "as available", and we give no other promises, warranties or conditions, express or implied, including about quality, fitness for a particular purpose, the accuracy of answers or results, or non-infringement.
24. Liability
24.1 What we never exclude. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that the law does not allow to be excluded or limited. If you are a consumer, nothing in these Terms excludes or limits our liability for loss or damage that we cause you deliberately or through gross negligence.
24.2 Consumers. If you are a consumer and we break these Terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it was obvious that it would happen, or if both of us knew it might happen when the contract was made. We are not responsible for loss or damage that was not foreseeable.
24.3 Business customers. If you are a business customer, then to the extent the law allows:
- (a) neither of us is liable to the other for loss of profit, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss; and
- (b) each party's total liability to the other arising out of or in connection with these Terms or aSERP is limited to the total amount you paid us for aSERP in the 12 months before the event that gave rise to the claim.
These limits do not apply to the liability described in section 24.1, to your obligation to pay for your plan, to your obligations under section 25, or to your liability for breaking section 14.4(b), (d), (e) or (f).
25. Indemnity (business customers)
25.1 Your indemnity. If you are a business customer, you will defend us against any claim by a third party, and pay any amount awarded against us or agreed in a settlement you approve, including reasonable legal costs, to the extent that the claim arises from:
- (a) your content, or our use of it in line with these Terms; or
- (b) your use of aSERP or its results in breach of section 14 or the law.
This does not apply to the extent that the claim is caused by our breach of these Terms.
25.2 How it works. We will tell you promptly about the claim, let you control its defence and settlement, and give you reasonable help at your expense. You may not settle a claim in a way that requires us to admit fault or to do anything, without our consent.
26. Changes to these Terms
26.1 Why we may change them. We update these Terms only for one of these reasons:
- (a) to reflect changes to aSERP that we make under section 21.3;
- (b) to reflect changes made by the engines or by our payment provider;
- (c) to follow a change in the law or a requirement of a court or an authority;
- (d) to make them clearer, without reducing your rights; or
- (e) to reflect a change in how our business is organised, such as a transfer under section 30.1.
26.2 Material changes. If a change materially affects your rights or obligations, we tell you by e-mail at least 30 days before it takes effect. Our notice summarises what is changing and tells you that, if you keep using aSERP after that date, the updated Terms will apply to you. If you do not agree, you can end your plan by telling us before the change takes effect, and we refund the unused part of any prepaid billing period. If you are a consumer and the law of the country where you live requires your express agreement to such a change, we ask for it, and the change applies to you only if you agree; if you do not, either of us may end your plan at the end of your current billing period. Otherwise, if you keep using aSERP after the change takes effect, the updated Terms apply to you.
26.3 Other changes. Other changes, such as clarifications and changes that do not reduce your rights, take effect when we publish them on this page, unless they state a later date. A change that the law requires takes effect when the law requires; if it materially affects you, we tell you by e-mail as early as we can.
26.4 Which version applies. The dates at the top of this page show when these Terms were last updated and when this version took effect.
27. Governing law and disputes
27.1 Talk to us first. If you have a problem with aSERP, please contact us first (section 31.2) so that we can try to resolve it. This does not affect your right to go to court or to a consumer authority.
27.2 Governing law. These Terms, and any dispute about them or about aSERP, are governed by the laws of the Kingdom of Saudi Arabia.
27.3 Consumers. If you are a consumer, this choice of law does not take away the protection of those laws of the country where you live that a contract cannot exclude. You can bring a claim in the courts of the country where you live, and we will bring a claim against you only in those courts.
28. Language of these Terms
These Terms are published in English and Arabic, and you can accept them in either language. Both versions are equally authoritative and are intended to say the same thing.
29. Notices
29.1 Notices to you. We send notices to the e-mail address of your account. Notices about a company account's plan or billing go to the billing e-mail address set in Billing or, if none is set, to its owners. We may also show notices in aSERP.
29.2 Notices to us. Send notices to complaints@aserp.com or by post to Riyadh 11411, Kingdom of Saudi Arabia. For questions, you can also use our contact form.
29.3 Electronic communication. You agree that we may communicate with you electronically, and that e-mail meets any legal requirement for communication in writing, as far as the law allows.
30. General
30.1 Transfer. We may transfer our rights and obligations under these Terms to another company, for example if we reorganise or sell our business, as long as this does not reduce your rights under these Terms. We will tell you if this happens. You may transfer your rights and obligations only with our written consent. If you are a consumer, you may end your plan within 30 days after we tell you about the transfer, and we refund the unused part of any prepaid billing period.
30.2 Service providers. We may use service providers to help us provide aSERP. We remain responsible for our obligations under these Terms.
30.3 Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as engine outages, failures of the internet or of power supplies, natural disasters, war or acts of government, as long as we take reasonable steps to limit their effect. This does not affect your rights under section 3.2 or any refund due under these Terms.
30.4 If a clause is invalid. If a court finds any part of these Terms invalid or unenforceable, the rest stays in force.
30.5 No waiver. If we do not enforce a right straight away, we can still enforce it later.
30.6 Whole agreement (business customers). If you are a business customer, these Terms, what is shown on the pricing page and at checkout when you buy, and any signed Custom agreement are the whole agreement between us about aSERP, and they replace any earlier discussions. You have not relied on any statement that is not in them. This does not limit liability for fraud.
30.7 No third-party rights. Only you and we can enforce these Terms, unless the law provides otherwise.
30.8 Independent parties. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship between you and us.
30.9 Your name and logo. We will not use your name or logo to promote aSERP without your permission.
30.10 Clauses that continue. Clauses that by their nature should continue after these Terms or your plan end continue to apply, including those on intellectual property, confidentiality, liability, indemnity and disputes.
